These terms govern the use of apexspan.com, the website of ApexSpan. By reading the site or sending a message through it, you accept them. If you do not accept them, please do not use the site.
Use of the site
The site is offered for information. You may read it, print it and share a link to it. You may not attempt to interfere with the site, gain access to any part of it that is not public, submit automated traffic to its forms, or use it to send anything unlawful.
The site forms no professional relationship
ApexSpan is engaged by written engagement letter, and by nothing else. Reading this site, sending a message through the contact form, or receiving a reply does not make ApexSpan your consultant, your executive or your agent. No engagement begins until the scope, the term and the fee are agreed in writing and signed.
Nothing here is advice
The site describes how the practice works. It is not financial advice, accounting advice, regulatory advice, investment advice or legal advice, and it is not a recommendation about any decision your institution faces. It is not a guarantee of any outcome. Descriptions of past work are generalized, with institution names and locations removed, and no past result predicts a future one.
Accuracy and changes
The site is kept current as a matter of practice, but it may contain errors and it may fall behind events. Content, pages and availability can change without notice. If something on the site matters to a decision you are making, confirm it directly with ApexSpan before you rely on it.
Intellectual property
The text, artwork, photographs, illustrations, logo and design of this site belong to ApexSpan and are protected by copyright and trademark law. You may quote a short passage with attribution and a link. You may not copy the site or substantial parts of it, reuse the artwork or the logo, or present any of it as your own work, without written permission.
Links to other sites
Where the site links to a page ApexSpan does not operate, the link is a convenience. ApexSpan does not control those pages, does not endorse them by linking to them, and is not responsible for their content, their accuracy or their handling of your information. Their terms and their privacy practices are their own.
Using the contact form
The contact form is for opening a conversation. Send enough to describe the situation and no more.
Do not send confidential or non-public supervisory information through this form. That includes examination reports, examination findings, supervisory correspondence, enforcement documents, board minutes, member or customer information, employee records and anything else your institution is obliged to protect. The form is ordinary web mail, not a secure channel, and the law restricts the disclosure of supervisory material. If a conversation reaches a point where that material matters, it is exchanged under an engagement letter and the confidentiality terms that go with it.
Anything you do send through the form, you confirm you are entitled to send.
Limitation of liability
The site is provided as it is. ApexSpan does not promise that it will always be available, that it will be free of errors, or that it will suit any particular purpose. To the extent the law allows, ApexSpan is not liable for any loss arising from the use of the site or from reliance on its content, including lost profit, lost data, business interruption or indirect loss. This section limits liability for the site. It does not limit anything agreed in an engagement letter, and it does not limit liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the jurisdiction in which ApexSpan is organized.
